These Terms govern your use of the Gold Identifier mobile application (the "App"), provided by MD TECH ("we", "us", the "Service Provider"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

1. Informational Use Only, Not an Appraisal

This is the most important term in this document. Please read it carefully.

• Gold Identifier analyzes photographs. It infers what an item most likely is from visible characteristics such as color, luster, form, surface texture and any legible stamps.
• A photograph cannot measure metal content. Karat figures, purity ranges and value estimates produced by the App are informational estimates only. They are not an assay, not a certification, and not a professional appraisal.
• Do not rely on the App alone for any buying, selling, lending, insuring, customs, tax or investment decision. Confirm anything of value with a hallmark inspection, an acid test, a specific-gravity test, or a professional XRF assay by a qualified jeweler or assayer.
• Live gold prices are supplied by third-party market data providers and may be delayed, incomplete or inaccurate. Calculated values are melt-value approximations and exclude dealer margins, refining fees, taxes, and any numismatic, brand, gemstone or craftsmanship premium.
• To the maximum extent permitted by law, we accept no liability for any loss, direct or indirect, arising from reliance on an identification, estimate, price or valuation produced by the App.

2. Licence and Restrictions

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control. You may not copy, modify, reverse-engineer, decompile, extract the source code of, translate, or create derivative works from the App. All trademarks, copyrights, database rights and other intellectual property in the App remain ours.

3. Your Content

You keep ownership of the photos you submit. You grant us a limited licence to process, store and transmit those images to the extent necessary to deliver identification results and the features you use. You confirm you have the right to submit any image you upload and that doing so does not infringe anyone else's rights.

You agree not to use the App to submit unlawful content, to misrepresent the App's output as a certified appraisal, or to attempt to disrupt or overload the service.

4. Subscriptions, Billing and Auto-Renewal

The App is free to download. Some features require a Premium subscription.

• Plans and prices: Premium Weekly at $4.99 USD per week, and Premium Annual at $29.99 USD per year. Prices may vary by region and are shown in the App before purchase.
• Billing: Payment is charged to your Apple ID or Google Play account at confirmation of purchase. We do not process payments and never see your card details.
• Auto-renewal: Subscriptions renew automatically at the same price for the same period unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Cancelling: Manage or cancel in your account settings. On iOS: Settings → your name → Subscriptions; on Android: Play Store → profile → Payments & subscriptions. Deleting the App does not cancel a subscription.
• Refunds: Refunds are handled by Apple and Google under their policies, not by us. Contact Apple Support or Google Play Support to request one. Unused portions of a current period are generally non-refundable.
• Price changes: If we change the price, you will be notified and asked to consent before the new price takes effect, in line with App Store and Google Play rules.

5. Availability, Connectivity and Updates

Some features require an active internet connection. We are not responsible if the App does not work at full capacity because of connectivity, data allowance, device battery, or a device or operating system we do not support. Your mobile carrier's charges, including roaming, remain your responsibility. We may release updates, and may change or discontinue features or the App itself at any time.

6. Device Security

You are responsible for the security of your device and for access to the App. We advise against jailbreaking or rooting your device, which can compromise its security and may cause the App to malfunction.

7. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that identifications, estimates or prices will be accurate, complete or uninterrupted.

8. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to the App is limited to the amount you paid us for the App in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or losses arising from any transaction you entered into in reliance on the App. Nothing in these Terms limits liability that cannot be limited by law, and some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

9. Termination

We may suspend or terminate your access if you breach these Terms. On termination, your licence ends and you must stop using and delete the App. Sections 1, 7, 8 and 10 survive termination.

10. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Nothing here removes any mandatory consumer protection rights you have in your country of residence.

11. Apple-Specific Terms

For downloads from the App Store, these Terms are between you and MD TECH, not Apple. Apple has no obligation to provide maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. The Apple Standard EULA also applies where it is not superseded by these Terms.

12. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted here with an updated date. Continued use after a change constitutes acceptance.
